Billionaire Elon Musk-led Tesla Inc. has recently filed a lawsuit against an Indian battery manufacturer. The reason behind the filing of this lawsuit is alleged copyright infringement. According to Tesla Inc., the Indian company had been using “Tesla Power” to promote its products. Tesla Inc. also added that despite receiving a cease-and-desist notice from them, the Indian company continued to use the brand name. This has now resulted in Tesla taking legal action.
Tesla Inc. Sues Indian Battery Maker
The American EV maker stated that it had sent a “Cease and Desist” notice to the Indian battery maker Tesla Power. However, the company ignored this notice. As per the reports, the lawsuit seeks unspecified damages and a permanent injunction against the Indian company.
According to the information available, Tesla accused the Indian battery manufacturer of using trade names like “Tesla Power” and “Tesla Power USA” without authorization. During the proceeding, Tesla Inc. presented various evidence. These included screenshots from a website, indicating that the Indian company was associating itself with Tesla Power USA LLC.
The company in court highlighted that the Indian company claimed to be headquartered in Delaware. And since Tesla itself is incorporated in Delaware, this further strengthened Tesla’s case against the Indian company.
What did the Indian company respond with?
During the court hearing, the Indian battery manufacturer argued that its primary business is producing lead-acid batteries. The company added that it has no intention of manufacturing electric vehicles.
They argued that their product is not the same as Tesla’s main line of business. The company maintained that it had been operating in India before Tesla. It also highlighted that it obtained all necessary government approvals. Additionally, they emphasized that they had never claimed any association with Elon Musk’s Tesla.
What did the court say?
The judge presiding over the case granted the Indian company three weeks to submit a written response. As per the current verdict, it has given the Indian company time to collect supporting documents in defense. The next hearing is scheduled for May 22. On this day, both parties will present their arguments and evidence before the court.
Affordable Tesla for India delayed
In other Tesla news, just a few weeks ago, it was reported that Tesla Inc. is planning to launch cars in India. However, recently it has been reported that the company may not be offering affordable EVs in the beginning after it makes its debut in India. Recently, Elon Musk, CEO of Tesla, also postponed his meeting with PM Narendra Modi in Delhi.
